1. Agreement to Terms

By accessing or using LinkInAgent's website (linkinagent.com) and services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

LinkInAgent provides AI-powered chatbot solutions and marketing automation services for small businesses, primarily in the real estate industry. Our services may include:

• AI chatbot widget installation and configuration
• Lead capture and qualification automation
• Email notification of qualified leads
• Optional digital advertising management

3. AI Disclosure

Our chatbot services utilize artificial intelligence to interact with website visitors. Conversations are conducted by an AI assistant, not a human. While our AI is designed to be helpful and accurate, it may occasionally provide imperfect responses. LinkInAgent is not responsible for any decisions made based solely on AI-generated responses.

4. User Accounts and Client Obligations

Clients who subscribe to our services agree to:

• Provide accurate business information during onboarding
• Respond to qualified leads in a timely manner
• Comply with all applicable laws regarding their business and industry
• Not use our services for any unlawful purpose
• Not attempt to reverse-engineer, copy, or redistribute our technology

5. Pricing and Payment

Service pricing is as outlined in the client's signed service agreement. All setup fees are non-refundable once work has begun. Monthly recurring fees are billed in advance. Failure to pay may result in suspension or termination of services.

6. Cancellation and Refunds

Clients may cancel monthly services with 30 days' written notice. Setup fees are non-refundable once chatbot configuration has commenced. No refunds are provided for partial months of service.

7. Intellectual Property

All technology, code, designs, and AI models powering LinkInAgent's services are the intellectual property of LinkInAgent. Clients retain ownership of their business data, leads, and any content they provide for chatbot configuration.

8. Data and Privacy

We collect and process data as described in our Privacy Policy. By using our services, you consent to such collection and processing.

9. Limitation of Liability

LinkInAgent is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We do not guarantee any specific number of leads, conversions, or sales results
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid to LinkInAgent by the client in the three (3) months preceding the claim
• We are not responsible for actions taken by website visitors based on AI generated responses
• Any sales or services indirect taxes that arise as a result of client's contract with LinkInAgent are the responsibility of the client

10. Indemnification

You agree to indemnify and hold harmless LinkInAgent, its owners, and affiliates from any claims, damages, or expenses arising from your use of our services or violation of these terms.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, United States. Any disputes shall be resolved in the courts of Illinois.
